GENERAL TERMS & CONDITIONS

Jurisdiction: All matters under these General Terms and Conditions are subject to Dutch Law and Jurisdiction. For translations or clarifications, the Dutch version of YoungYarn’s website remains primary.

1 GENERAL: These terms are applicable to all transactions between YoungYarn and its consumers. Acceptance of these terms is implied when placing an order with YoungYarn. YoungYarn works towards establishing a circular economy to minimize the amount of items reaching landfills. Consumers have the option to purchase or rent items from our site, which features a range of new and preloved products available for both purchase and rental.

2 ORDERS: Upon placing an order, the consumer will promptly receive an email confirming the details and the total costs associated with the order. All orders will be dispatched within five working days following the receipt of payment by the consumer. However, in the event of a technical malfunction, which is categorized as circumstances beyond YoungYarn’s control, an order will be dispatched as soon as feasibly possible. YoungYarn will keep the consumer adequately informed of the order status. We aim to maintain our website (www.youngyarn.com) as up-to-date as possible. Nevertheless, there is a possibility that a certain item may no longer be available, in which scenario we will reach out to the consumer promptly. An item must be delivered to the consumer within 30 days of placing the order. If YoungYarn fails to fulfill this, the consumer has the right to terminate the order contract immediately. However, this is not applicable if a different delivery term has been previously agreed upon by the parties involved. If you purchase an item, you are not required to participate in our Give Back program, but we encourage you to do so. Some of our items are available for rental only, and not for purchase.

3 RENTALS: You may rent items directly from our site for a minimum of one month and a maximum of approximately six months (maximum timing may vary based on original retail price), at which point you will own the item. You will never be charged more than the retail price of an item. When you rent our items, you will automatically be charged your rental fee for one month (the required minimum rental time frame). If you intend to Give Back (return) your rental items after the first month (or at any time during your rental period) you must have your items scanned by a shipping provider before your rental renewal date to avoid being charged the next month's rental fee. We are unable to refund partial and/or unintended rental fees. Some of our items are available for purchase only, and not for rental.

4 PRICES: Prices on YoungYarn’s website are in Euros, including VAT. Shipping costs shall be added according to the list. 

5 PAYMENT: We accept payments through several methods such as iDeal, credit card, PayPal, Bancontact, Sofort, Klarna Pay Later, and direct debit. For the safe processing of your payments, we transmit your data through a secure connection to our payment service provider, Stripe, upon the completion of your order.

a) Payment via iDeal: As this is one of the most preferred methods in the Netherlands, you will be redirected to one of the participating Dutch banks. Within your bank's online banking, you can complete the transfer. Further instructions will be provided during the order process. The goods will be dispatched once the amount has been received in our bank account.

b) Payment via Bancontact: This method is available for our Belgian customers. You'll be redirected to the Bancontact payment gateway to complete your transaction. Further instructions will be given as you progress through the order process. The goods will be sent upon the receipt of the payment in our bank account.

c) Payment via Sofort: For our customers in Germany and other supported countries, Sofort is a convenient online payment method. You will be redirected to the Sofort gateway to complete the transaction. Further instructions are provided during the order process, and the goods are dispatched once the funds are received.

d) Payment via Klarna Pay Later: With Klarna Pay Later, you can receive your goods first and pay within a specified period after receiving the invoice. Please follow the instructions provided during the order process. The goods will be dispatched upon approval from Klarna.

e) Payment via PayPal: For this method, you pay the invoiced amount via the online service provider PayPal. You must be registered or register with PayPal, authenticate with your access data, and confirm the payment instruction to us (except in cases of guest access, if applicable). Further instructions are provided during the order process, and the goods are dispatched once we receive the funds.

f) Payment by Credit Card: Upon completing the payment process, your credit card account will be charged immediately. The payment processor will carry out and store all entries and checks relating to your payments.

g) Payment by Direct Debit: By choosing to pay by direct debit, you authorize us to collect the invoiced amount from your specified account revocably. If the direct debit cannot be redeemed due to insufficient funds, incorrect bank account details, or unauthorized objection to the debit, you will bear any costs and fees of the chargeback, if responsible. The account will be debited before the shipment of the goods.

All payments should be made to YoungYarn without any deductions. A payment is considered made only once the amount is freely available to us.

General discount clause:

a) discount codes cannot be applied retroactively, unfortunately.

b) discount codes do not apply for reduced articles.

7 DELIVERY: YoungYarn commits to dispatching orders promptly, but exact delivery timeframes aren't guaranteed. However, extended delays are rare and typically due to 'force majeure'. We aren't liable for postal delays.

8 RETURNS: YoungYarn welcomes your returns with understanding. Items must be returned within 30 days from the date of delivery. Please return all items in its original packaging and with the original hang tags. YoungYarn will not accept any items that have been washed, worn, stained, damaged or altered in any way. Items that do not meet these conditions will be returned to the sender, minus the shipping costs for returning the items.

Exchanging an item for a different style is not possible. In that case the order will be refunded, any new items can be bought in the online store.

All returns must be sent back with a note containing the order number, reason for return, and preference for exchange or refund. If a return is unidentifiable, a refund may not be possible. Once received, returns will be processed within 7 days. The refund for the returned items will be issued to the original payment method. Please note, shipping costs are non-refundable and at the customer’s expense.These will be deducted from the refund amount. 

If YoungYarn sent the wrong item or the item appears to be damaged upon arrival, contact hello@youngyarn.com within 14 days from receiving the item(s). We will refund the return shipping costs and send you the new and correct items as soon as possible, if stock is available.

YoungYarn recommends sending your return with a traceable shipping provider, so please keep your track & trace receipt to track your order. We have no information on your return while it is on its way to us. Shipping costs for returning are the responsibility of the customer. Lost packages will not be refunded. Direct returns to our main office in Amsterdam are not accepted. If you return Product after 30 business days from your order receipt, you are then eligible for 20% Give Back credit, not the full value of your original purchase.

9 PRELOVED ITEMS: In alignment with our sustainability initiatives, we offer “preloved” garments—items that have been previously used but remain in excellent condition. These items are not eligible for standard discounts and promotional codes. We strive to maximize the longevity of each product, thoroughly cleaning and repairing any returned items until they meet our strict “like new” quality criteria. If an item no longer aligns with these standards, we responsibly recycle or repurpose it, ensuring its materials are given a new life.

10 GIVE BACK CREDITS: You may return any Product purchased through our website, at any time, to receive 20% of the retail price paid back to you in YoungYarn store credit (called Give Back Credit). The Give Back Credit applies to Products originally purchased from our site, and products that were originally rented but then subsequently purchased from our site. Give Back Credits can be used towards future purchases and/or rentals.

11 TRANSFER OF OWNERSHIP: Until the purchaser has fulfilled the associated obligations, ownership of the goods will not be transferred. Product liability is transferred to the purchaser at the point of delivery of the items, which is when the transfer of ownership occurs.

12 MONEY BACK GUARANTEE: If the consumer, for whatever reason, does not wish to keep the item, the consumer has the right to return the item to YoungYarn within thirty working days after taking delivery of the item. The consumer must first inform YoungYarn via the online portal or in writing via email of their intention, and must follow all further return conditions and instructions stipulated by YoungYarn. This guarantee does not comply if the item has been worn or washed, or if the consumer has attempted to mend or alter the item in any way. Return items will only be accepted if it is sent in the original, undamaged packaging and the labels are still attached to the merchandise. Furthermore, the shipping costs of the returned items will be entirely paid for by the consumer. Under no circumstances will YoungYarn reimburse the shipping costs of returned items. If the return instructions have been followed accurately, YoungYarn will reimburse the consumer for the returned item(s) within seven days after receiving it.

14 PRIVACY, ADVERTISING VIA EMAIL: YoungYarn places immense importance on handling each consumer’s personal information with the highest degree of care and security. We strictly adhere to privacy laws and regulations, ensuring that third parties will not be given access to the consumer’s personal information, except when it is necessary for fulfilling an order. For the processing of an order, YoungYarn necessitates the consumer’s name, invoice and delivery addresses, and payment details, which are solely used for completing the payment process.

In the context of order processing, including transmission to the order processing or shipping partner used, we will retain your order and address data for use in any warranty claims and for making product recommendations to customers, in accordance with our privacy policy and applicable data protection laws. You can find our Privacy Policy, as well as our Cookie Policy, on our website.

If a consumer opts to subscribe to our newsletter, their personal information will be utilized to keep them updated on changes to our assortment, special offers, enhancements to our website, and other pertinent information relating to YoungYarn. Additionally, for statistical purposes, records of website visits are maintained. Information regarding the number of visitors and the frequency of visits to our website will be employed for internal research and improvements to the website. Nonetheless, this generalized information is anonymous and cannot be attributed to an individual visitor.

In the event of the conclusion of a contract, we may send you advertising for similar goods by email from time to time. If you prefer not to receive such promotional emails, you have the option to refute the use of your email address by contacting us at the following email address: hello@youngyarn.com. 

15 LIABILITY: Every item in YoungYarn's assortment has been crafted with the utmost care. YoungYarn cannot be held liable for damages of any kind, be it physical, material, or immaterial, resulting from malfunction or improper use of the items sold by YoungYarn and/or from materials or accessories coming undone. The website's content has been compiled with meticulous attention; however, YoungYarn cannot rule out the occurrence of errors or inaccuracies in the information provided on this website. YoungYarn cannot accept liability for the repercussions of incorrect or incomplete information on the website. YoungYarn cannot be held accountable for any typographical or misprinting errors that might convey an incorrect selling price. In such instances, YoungYarn will rectify the price promptly. The actual colour of the products may vary from the colours viewed on computer screens. YoungYarn is not liable for variations in colours due to the quality of computer screens. The placement and size of the actual applications and/or sequins on the clothing may slightly vary from what is displayed on the website, for which YoungYarn cannot be held responsible. Certain links on the website may lead to websites and information managed and maintained by third parties. YoungYarn does not oversee these sites and is not accountable for the content present on them.

16 CARE: Please adhere to the care instructions found on the labels of the items. Should the care guidelines not be followed correctly, or if alterations have been made to the products, or if care materials that we have advised against are used, and/or if materials explicitly deemed by us as not suitable for the purchased item are used, or if they don't meet the standard quality expectations, no warranty will be provided.

17 FORCE MAJEURE: In the event of Force Majeure, notwithstanding any other established legal rights, YoungYarn reserves the right, at its own choice, to either cancel your order or terminate the purchase agreement without judicial intervention, by notifying the client in writing. The client is not entitled to any compensation, unless, given the circumstances, this would be unreasonable and unfair.

18 COPYRIGHT: All information contained on YoungYarn’s websites is protected by copyright. Copying, using, or distributing any information from YoungYarn’s website without first obtaining written permission is illegal. Visitors and users of YoungYarn’s website may not assert any rights relating to the information on the website. None of the text or graphics from YoungYarn’s websites may be used publicly or copied, whether partially or wholly, for printing, photocopying, overtyping, inclusion in an electronic database, or for any other form of reproduction.

19 ACCEPTANCE OF GENERAL CONDITIONS: All users of the website are required to be aware of, and to agree with, all of the above General Conditions. By placing an order with YoungYarn, the consumer automatically agrees to all of our General Conditions. YoungYarn’s consumer's details are automatically stored in our consumer list and will receive our newsletter.
